1. Definitions

“Client” refers to the employer using the AdHyre platform.

“Candidate” refers to the job seeker using the AdHyre platform.

“Subscription” refers to the paid service plan selected by the Client.

2. Platform Overview

AdHyre is a digital platform operated by ByHyre B.V., designed to facilitate connections between employers and job seekers. Employers can publish vacancies and candidates can apply directly through the platform.

Employers may choose from three subscription packages: Start-up, Scale-up, and Enterprise. All subscriptions are valid for a period of one (1) year and will automatically renew for the same term unless terminated in writing at least thirty (30) days prior to the renewal date.

3. Account Access & Use

All users, both employers and candidates, are required to register an account to access platform services.

Employers may access the platform only upon entering into a paid subscription agreement.

Users are prohibited from posting false or misleading job listings, discriminatory content, promoting illegal goods or services, or any content that may harm others.

ByHyre reserves the right to suspend or permanently deactivate any account, without prior notice, in the event of misuse or a breach of these Terms.

4. Fees & Payment Terms

Employers may select either monthly billing or annual billing, with a 10% discount applied to annual payments.

Enterprise subscribers may request additional recruitment services. These services are governed by these Terms & Conditions, with the sole exception that the recruitment placement fee for AdHyre Enterprise users is fixed at 12.5% of the agreed gross annual salary.

A 2.5% deposit is due upon commencement of the assignment. An additional 10% is invoiced upon signing of an employment agreement between the client and candidate — totaling the agreed 12.5% fee.

Note: If a candidate was introduced through a proactive search by AdHyre and is not initially hired, but applies and is hired directly by the client within six (6) months of the initial introduction, the full 12.5% placement fee still applies.

5. Cancellation & Termination

Employers may cancel their subscription at any time; however, cancellation does not affect the payment obligation for the full annual term.

Candidates may delete their accounts at any time via their profile settings.

No refunds will be issued once a subscription period has commenced.

6. Access After Termination

Upon termination or expiration of the subscription, the Client's access to their AdHyre account will be disabled. This includes access to all features, dashboards, and candidate data previously available during the active subscription.

Clients understand and agree that:

  • Any candidate database or information obtained via AdHyre is no longer accessible after the subscription ends.
  • Clients are not permitted to export, store, or otherwise retain personal data of candidates outside of the platform unless explicit consent was given by the candidate through the Client’s own communication channel (e.g., direct email or application form).
  • Any data usage beyond the scope of the AdHyre platform without such consent constitutes a violation of data protection laws and these Terms.

7. No Guarantee of Outcomes

ByHyre provides a platform to facilitate job postings and candidate applications but makes no guarantees regarding successful matches, placements, or hiring results.

8. Payment Terms & Late Fees

Subscription fees are collected via SEPA direct debit unless otherwise agreed in writing.

Manual invoices must be paid within fourteen (14) calendar days of issuance.

In the event of late payment, the client will be in default without further notice. Interest will accrue at 2.5% per month on the outstanding balance.

9. Intellectual Property

All intellectual property rights related to the AdHyre platform, including but not limited to its design, functionality, logo, branding, and content, are the exclusive property of ByHyre B.V. No rights are transferred or granted to users except as necessary for using the platform in accordance with these Terms.

10. Data Protection

All personal data is processed in accordance with our Privacy Policy. By using the platform, you consent to the collection and processing of your data as outlined therein.

11. Limitation of Liability

ByHyre shall not be liable for any direct, indirect, incidental, or consequential damages arising from use of the platform, its services, or any employment relationship formed between users. Employers and candidates acknowledge that ByHyre does not act as a party to employment agreements and does not mediate or monitor such relationships beyond its platform’s intended function.

12. Force Majeure

ByHyre shall not be held liable for failure or delay in fulfilling its obligations where such failure results from causes beyond its reasonable control, including but not limited to acts of God, war, terrorism, strikes, utility outages, or failures in internet connectivity.

13. Governing Law & Jurisdiction

These Terms & Conditions are governed by the laws of the Netherlands. Any disputes arising in relation to these terms shall be exclusively resolved by the competent court in Amsterdam, the Netherlands.
